You may remember how Longview, TX got itself into a pickle by selecting a logo, "East Texas, Pure and Simple. They subsequently found out that two communities, one in Florida and one in Colorado, were already using the "pure and simple" tag line.
Well, the mayor of Longview, not surprisingly, fired the consultant. Read more. Despite the action, it's proven difficult to unwind the problem. Read more.
(It might make sense for communities to include a clause in their consulting contracts to the effect that the consultant certifies that 1) substantially all the work done for the community is original; 2) the origin of any derivative work will be clearly specified; and 3) if the consultant breaches the clause, they will pay liquidated damages of a specified amount.)
